Official Rules of the Custom Truck One Source 2024 12 Days of Christmas Social Media Giveaway

- Sponsor: The Sponsor of the Campaign is Custom Truck One Source, 7701 E. 24 Hwy, Kansas City, MO. 64125.
- Eligibility: This Campaign run by Custom Truck One Source is open only to those who enter and who are 18 years or older as of the date of entry. The Campaign is only open to legal residents of the United States and is void where prohibited by law. Employees of Sponsor, and their parent companies, affiliates, subsidiaries, sales representatives, advertising, sales promotion, and all other service agencies involved with the development, production, implementation, administration, or fulfillment of the giveaway, or individuals living in the same household (whether related or not) of any of the above are not eligible to participate. The Campaign is subject to all applicable federal, state, and local laws and regulations. Void where prohibited.
- Agreement to Rules: By participating, the Contestant (“You”) agrees to be fully unconditionally bound by these Rules, and You represent and warrant that You meet the eligibility requirements. In addition, You agree to accept the decisions of the Sponsor as final and binding as it relates to the content of this Campaign.
- Campaign Period: Entries will be accepted online starting on December 9, 2024, at 9:01 AM PT and ending December 20, 2024 at 11:59 PM PT. Sponsor’s clock is the official timekeeping device for the Giveaway.
- How to Enter: The entry must fulfill all Campaign requirements, as specified, to be eligible to win a prize. To enter, participants must follow Custom Truck One Source on Instagram, which can be done here: https://www.instagram.com/ctonesource/. Additionally, comment on the post of the day to be eligible to win that day's prize. One (1) bonus entry may apply if that day's prize is shared via Instagram Stories and Custom Truck One Source is tagged. If you are selected as the prize winner, your information may also be included in a publicly-available winners’ list.
Entries that are late, lost, stolen, undelivered, illegible, damaged, misdirected, mutilated, garbled, incomplete, altered or otherwise irregular, generated by script, macro or other automated or mechanical means, or that contain false information, have been submitted through illicit means or by any means which subvert the entry process, or that do not conform with or satisfy any or all of the conditions set out in these Official Rules will be void. You may enter only once per day. You must provide the information requested. You may not enter more times than indicated by using multiple email addresses, identities, or devices in an attempt to circumvent the official rules. If You use fraudulent methods, post inappropriate comments or content, or otherwise attempt to circumvent the Rules, Your submission may be removed From eligibility at the sole discretion of the Sponsor.
- Prizes: The Winner(s) of the Campaign (the “Winner”) for each day will receive the following:

The specifics of the prize shall be solely determined by the Sponsor. No cash or other prize substitution shall be permitted except at the Sponsor’s discretion. The prize is nontransferable. Any and all prize-related expenses, including without limitation any and all federal, state, and/or local taxes, shall be the sole responsibility of Winner. No substitution of prize or transfer/assignment of prize to others or request for the cash equivalent by Winner is permitted. Acceptance of prize constitutes permission for the Sponsor to use Winner’s name, likeness, and entry for purposes of advertising and trade without further compensation, unless prohibited by law. The winners may be required to execute and return an affidavit of eligibility and liability release by returning the affidavit by regular mail within seven (7) days of the attempted notification. If a Winner is eighteen (18) years of age, but an eligible minor in state of residence, the prize will be awarded to a parent/legal guardian of the winner who must execute and return any required documents as noted in these Official Rules. Prizes will be mailed (or emailed for Gift Cards) to Winners beginning in January 2024 as long as valid shipping addresses were given at the time of entry.
- Odds: The odds of winning depend on the number of eligible entries received.
- Winner Selection and Notification: There will be one (1) Winner for each day of the Campaign, 12 Winners total. Winner may only win one time. Winner will be selected by random under the supervision of the Sponsor. Winner will be notified by direct message via Instagram the next day. The Sponsor shall have no liability for Winner’s failure to receive notices due to non-functioning contact information. If Winner cannot be contacted, is ineligible, fails to claim the prize within 30 days from the time award notification was sent, or fails to timely return a completed and executed declaration and release as required, the prize may be forfeited, and an alternate Winner selected. Receipt by Winner of the prize offered in this Campaign is conditioned upon compliance with any and all federal, state, and local laws and regulations. ANY VIOLATION OF THESE OFFICIAL RULES BY WINNER (AT CUSTOM TRUCK ONE SOURCE’S SOLE DISCRETION) WILL RESULT IN WINNER’S DISQUALIFICATION AS WINNER OF THE CAMPAIGN, AND ALL PRIVILEGES AS WINNER WILL BE IMMEDIATELY TERMINATED.
- Rights Granted by You: By entering this content (e.g., photo, video, text, etc.), You understand and agree that the Sponsor, anyone acting on behalf of the Sponsor, and the Sponsor’s licensees, successors, and assigns, shall have the right, where permitted by law, to print, publish, broadcast, distribute, and use in any media now known or hereafter developed, in perpetuity and throughout the World, without limitation, your entry, name, portrait, picture, voice, likeness, image, statements about the Campaign, and biographical information for news, publicity, information, trade, advertising, public relations, and promotional purposes. without any further compensation, notice, review, or consent.
- Terms & Conditions: The Sponsor reserves the right, in its sole discretion, to cancel, terminate, modify or suspend the Campaign should virus, bug, non-authorized human intervention, fraud, or other cause beyond the Sponsor’s control corrupt or affect the administration, security, fairness, or proper conduct of the Campaign. In such case, the Sponsor may select the Winner from all eligible entries received prior to and/or after (if appropriate) the action taken by the Sponsor. The Sponsor reserves the right, in its sole discretion, to disqualify any individual who tampers or attempts to tamper with the entry process or the operation of the Campaign or website or violates these Terms & Conditions. The Sponsor has the right, in its sole discretion, to maintain the integrity of the Campaign, to void votes for any reason, including, but not limited to: multiple entries from the same user from different IP addresses; multiple entries from the same computer in excess of that allowed by Campaign rules; or the use of bots, macros, scripts, or other technical means for entering. Any attempt by an entrant to deliberately damage any website or undermine the legitimate operation of the Campaign may be a violation of criminal and civil laws. Should such attempt be made, the Sponsor reserves the right to seek damages to the fullest extent permitted by law.
- Limitation of Liability: By entering, You agree to release and hold harmless the Sponsor and its subsidiaries, affiliates, advertising and promotion agencies, partners, representatives, agents, successors, assigns, employees, officers, and directors from any liability, illness, injury, death, loss, litigation, claim, or damage that may occur, directly or indirectly, whether caused by negligence or not, from: (i) such entrant’s participation in the Campaign and/or his/her acceptance, possession, use, or misuse of any prize or any portion thereof; (ii) technical failures of any kind, including but not limited to the malfunction of any computer, cable, network, hardware, or software, or other mechanical equipment; (iii) the unavailability or inaccessibility of any transmissions, telephone, or Internet service; (iv) unauthorized human intervention in any part of the entry process or the Promotion; or (v) electronic or human error in the administration of the Promotion or the processing of entries.
- Disputes: THIS Campaign IS GOVERNED BY THE LAWS OF THE UNITED STATES OF AMERICA AND THE STATE OF MISSOURI, WITHOUT RESPECT TO CONFLICT OF LAW DOCTRINES. As a condition of participating in this Campaign, participant agrees that any and all disputes that cannot be resolved between the parties and causes of action arising out of or connected with this Campaign, shall be resolved individually, without resort to any form of class action, exclusively before a court located in Missouri having jurisdiction. Further, in any such dispute, under no circumstances shall participant be permitted to obtain awards for, and hereby waives all rights to, punitive, incidental, or consequential damages, including reasonable attorney’s fees, other than participant’s actual out-of-pocket expenses (i.e. costs associated with entering this Campaign). Participant further waives all rights to have damages multiplied or increased. In the event of a dispute regarding the identity of an entrant, such entry will be deemed to be made by the authorized account holder of the email address submitted at the time of entry in connection with the social media account used to enter the Giveaway. “Authorized account holder” of an email address is deemed as the natural person who is assigned to an email address by an Internet access provider, service provider or other online organization that is responsible for assigning email addresses for the domain associated with the submitted email address. The “authorized account holder” of a social medial account is the natural person in whose name the social media account has been issued
- Winners List: To obtain a copy of the Winner’s name or a copy of these Official Rules, mail your request along with a stamped, self-addressed envelope to: Custom Truck One Source, 7701 E. 24 Hwy, Kansas City, MO. 64125. Requests must be received no later than December 31, 2024 at 9:00 PM PT.
- Social Media: The Campaign hosted by Custom Truck One Source is in no way sponsored, endorsed, administered by, or associated with Facebook, Twitter, Instagram, TikTok or LinkedIn (collectively “Social Networks”). You understand that you are providing information to Sponsor only, and not to Social Networks. Any questions or communications should be directed to Sponsor and not to Social Networks. By participating in the Giveaway, you agree to a complete release of Social Networks from any claims.
